Aturan Hukum Mengubah Lahan Fasum Jadi Tempat Tinggal
Kamu bisa cari tahu beberapa aturan hukum yang berkaitan dengan menghubah lahan fasum menjadi tempat tinggal secara lengkap berikut ini:
1. Pasal 50 Angka 14 Undang Undang Cipta Kerja
Pasal ini mengubah Pasal 134 UU 1/2011 yang mengatur setiap orang dilarang menyelenggarakan pembangunan perumahan yang tidak sesuai dengan kriteria, spesifikasi, persyaratan, prasarana, sarana, utilitas umum yang diperjanjikan sesuai standar.
2. Pasal 17 Ayat 6 Peraturan Pemerintah Nomor 12 Tahun 2021
Standar sarana perumahan paling sedikit meliputi ruang terbuka hijau dan sarana umum yang meliputi rumah ibadah, tempat bermain anak-anak, tempat olahraga, dan papan penunjuk jalan.
Berdasarkan kedua aturan hukum tersebut, maka mengubah fasilitas umum menjadi tempat tinggal maka hal ini sudah tidak sesuai dengan standar sarana menurut Undang-Undang.
Jika hal tersebut sudah terjadi, maka kamu harus melihat kembali perjanjian jual beli rumah berdasarkan ketentuan sarana prasarana, hingga utilitas umum yang telah dijanjikan oleh pengembang.
Selain faktor tersebut, pihak pengembang juga dapat dijerat pidana jika mengakibatkan timbulnya korban/kerusakan terhadap kesehatan, keselamatan, dan/atau lingkungan.
Aturan tersebut berdasarkan Pasal 50 angka 16 UU Cipta Kerja yang mengubah Pasal 151 UU 1/2011 berikut ini.
“Setiap orang yang menyelenggarakan pembangunan perumahan yang tidak sesuai dengan kriteria, spesifikasi, persyaratan, prasarana, sarana dan utilitas umum yang diperjanjikan.”
Sesuai dengan Pasal 134 yang mengakibatkan timbulnya korban/kerusakan terhadap kesehatan, keselamatan, dan/atau lingkungan dipidana dengan denda paling banyak Rp5 miliar.”

Sanksi untuk Pengembang yang Mengubah Lahan Fasum Jadi Tempat Tinggal
Jika lahan fasum jadi tempat tinggal sudah terjadi, maka ada beberapa sanksi administratif yang berupa:
1. Peringatan tertulis.
2. Pembatasan kegiatan pembangunan.
3. Penghentian pekerjaan pembangunan untuk sementara.
4. Penghentian sementara atau tetap pengelolaan hunian.
5. Penguasaan sementara oleh pemerintah.
6. Membongkar bangunan sendiri dalam waktu tertentu.
7. Membangun kembali perumahan sesuai dengan kriteria yang sudah diperjanjikan.
Sanksi untuk pengembang juga meliputi:
1. Pembatasan kegiatan usaha.
2. Pembekuan persetujuan bangunan gedung.
3. Persetujuan bangunan gedung dicabut.
4. Pencabutan surat bukti kepemilikan rumah.
5. Pembongkaran bangunan rumah.
6. Pembekuan Perizinan Berusaha.
7. Pencabutan Perizinan Berusaha.
8. Pengawasan.
9. Pembatalan Perizinan Berusaha.
10. Kewajiban pemulihan fungsi lahan dalam jangka waktu tertentu.
11. Pencabutan insentif.
12. Denda administratif hingga penutupan lokasi.
Upaya Hukum Jika Lahan Fasum Menjadi Tempat Tinggal
Apabila lahan fasum jadi tempat tinggal akan segera dibangun, maka langkah hukum yang bisa ditempuh oleh perkumpulan warga antara lain:
1. Rapat warga dengan pengembang untuk mencari solusi bersama yang saling menguntungkan.
2. Melaporkan dinas terkait karena adanya perubahan fasilitas umum dan sosial agar dapat ditertibkan sesuai dengan peruntukkan.
3. Melaporkan pada kepolisian jika pengubahan fasilitas umum mengakibatkan korban/kerusakan terhadap kesehatan, keselamatan dan/atau lingkungan.
4. Menggugat secara perdata ke Pengadilan Negeri karena perbuatan melanggar hukum mengubah fasos/fasum menjadi properti pribadi.
5. Menggugat ke Pengadilan Tata Usaha Negara (PTUN) terkait dugaan sertifikat di atas fasos/fasum.
